Distance Sales Agreement for goods presented on Essens.ru

1. General provisions

1.1. This Offer is developed in accordance with Articles 435–438 of the Civil Code of the Russian Federation, the Law of the Russian Federation “On Protection of Consumer Rights” and the Rules for the Sale of Goods under a Retail Sales Agreement.

1.2. The Offer is addressed to an indefinite circle of persons and is public.

1.3. The goods presented on the Website are intended for personal, family, household or other use not related to entrepreneurial activity.

2. Subject of the agreement

2.1. The Seller undertakes to transfer the goods to the Buyer, and the Buyer undertakes to accept and pay for the goods on the terms of this Offer.

2.2. The name, assortment, characteristics and price of the goods are determined on the basis of the Buyer’s order placed on the Website.

2.3. The Seller guarantees that the goods comply with the requirements of the legislation of the Russian Federation and are fit for the purposes for which goods of this kind are normally used.

3. Procedure for concluding the agreement (acceptance)

3.1. Acceptance of this Offer (full and unconditional acceptance of its terms) is the placement of an order on the Website and/or its payment.

3.2. From the moment of acceptance, the agreement is considered concluded.

3.3. By placing an order, the Buyer confirms that they have read this Offer, the Personal Data Processing Policy, and consents to the processing of personal data to the extent necessary for the performance of the order.

4. Price and payment procedure

4.1. The price of the goods is indicated on the Website in Russian rubles.

4.2. Payment is made by prepayment or upon receipt, depending on the method chosen by the Buyer.

4.3. The Seller has the right to change prices for goods before the order is placed. The price fixed in the order is not subject to change.

5. Delivery of goods

5.1. Delivery is carried out to the address specified by the Buyer when placing the order.

5.2. Delivery times and costs are determined by the selected delivery service and are indicated when placing the order.

5.3. Ownership of the goods passes to the Buyer from the moment the goods are received.

6. Return of goods

6.1. Return of goods of proper quality. The Buyer has the right to refuse the goods at any time before their transfer, and after transfer — within 7 (seven) days. The return is carried out in any convenient way for the Buyer that ensures the possibility of checking the condition of the goods upon receipt by the Seller (including via a delivery service or postal service). The Buyer bears the costs of return delivery.

6.2. Return of goods of improper quality. The Buyer has the right to demand replacement or a refund. In this case, the Seller bears the delivery costs.

6.3. Refunds are made within 10 (ten) days from the moment the Buyer’s request is received, in the same way as the payment was made.

7. Liability of the parties

7.1. The parties are liable in accordance with the legislation of the Russian Federation.

7.2. The Seller is not liable for improper use of the goods by the Buyer.

8. Claims and dispute resolution

8.1. Claims are sent to shop@essens.ru or to the Seller’s postal address.

8.2. The claim review period is 30 (thirty) calendar days.

8.3. If no agreement is reached, the dispute is referred to the court in accordance with the legislation of the Russian Federation.

9. Personal data

9.1. The processing of the Buyer’s personal data is carried out in accordance with the Personal Data Processing Policy available at https://essens.ru/en/policy.html and the separate Consent to Personal Data Processing.

9.2. By placing an order, the Buyer confirms that they have read these documents.

10. Validity and amendment of the offer

10.1. The Offer is valid indefinitely until revoked by the Seller.

10.2. The Seller has the right to amend the Offer. The new revision comes into force from the moment it is posted on the Website.

11. Final provisions

11.1. All questions regarding the Offer shall be sent to shop@essens.ru.
