Terms of use of Essens.ru: registration, content, reviews, feed, statuses

1. General provisions

1.1. Use of the Website means the User’s consent to these Rules. If the User disagrees, the User must stop using the Website.

1.2. The Website is for advertising and informational purposes, is not the official website of Essens and is owned by a distributor.

1.3. Use of the Website is permitted to persons who have reached 18 years of age, or persons who have obtained the consent of their legal representatives.

2. Terms

2.1. Website — the set of pages located at https://essens.ru/.

2.2. User — any person accessing the Website.

2.3. User content — reviews, questions, comments, statuses, feed posts, images and other materials posted by the User.

2.4. Moderation — review and, if necessary, deletion or hiding of user content by the Administration.

3. Registration and account

3.1. Access to certain features of the Website (personal account, feed, statuses, reviews) may require registration.

3.2. The User undertakes to provide accurate data and not to transfer access to their account to third parties.

3.3. The User is responsible for the security of their password and for all actions performed under their account.

4. Rights and obligations of the User

4.1. The User has the right to:

• view the Website pages, catalog and product information;
• leave reviews and questions on products;
• leave comments on pages where this feature is available;
• publish posts in the feed and set statuses;
• contact the Administration regarding the operation of the Website.

4.2. The User undertakes to:

• not violate the legislation of the Russian Federation or the rights of third parties;
• not post false, offensive or defamatory information;
• not publish advertising, spam or materials unrelated to the Website’s subject;
• not attempt hacking, parsing or distribution of malicious code;
• comply with these Rules.

5. Rights and obligations of the Administration

5.1. The Administration has the right to moderate user content, hide or delete materials that violate the Rules or the legislation of the Russian Federation.

5.2. The Administration has the right to restrict the User’s access to certain features of the Website or block the account in case of systematic violations.

5.3. The Administration has the right to change the functionality of the Website and suspend its operation for maintenance.

5.4. The Administration is not obliged to publish or preserve user content if it violates the Rules.

6. User content: general terms

6.1. By posting content, the User confirms that they have the rights to publish it and that it does not violate the rights of third parties.

6.2. The User is responsible for the content of their own materials.

6.3. By posting content, the User grants the Administration a royalty-free right to use it to the extent necessary for display on the Website.

7. Product reviews and questions

7.1. Products have the features “Reviews” and “Questions”.

7.2. Reviews must be based on personal experience with the product. It is prohibited to publish reviews unrelated to the product, containing insults, advertising or false information.

7.3. Questions must relate to the properties, use, delivery or other characteristics of the product.

7.4. The Administration has the right to hide reviews and questions that violate the Rules without prior notice.

8. Page comments

8.1. On Website pages where the comment feature is enabled, the User may leave comments on the topic of the page.

8.2. Comments containing spam, advertising, insults, incitement to hatred or links to malicious resources are prohibited.

8.3. The Administration has the right to delete comments that violate the Rules and to restrict commenting for individual Users.

9. Feed and statuses

9.1. The User has access to the feed — a section where posts are published — and statuses — short messages about the current state or thoughts.

9.2. In the feed and statuses, it is prohibited to publish content that violates the legislation of the Russian Federation, the rights of third parties, contains spam or advertising of third-party resources without agreement with the Administration.

9.3. The Administration has the right to hide individual posts and statuses and to restrict the User’s access to these features in case of violations.

10. Forum

10.1. The forum that previously operated on the Website is closed and is no longer available for posting messages.

10.2. Forum materials may be preserved in archival form, but new messages, topics and replies are not created.

10.3. Discussions previously held on the forum are transferred to the feed and comments to the extent determined by the Administration.

11. Prohibited content and actions

11.1. It is prohibited to post on the Website:

• content that violates the legislation of the Russian Federation;
• insults, threats, defamation, incitement to hatred;
• pornographic materials, scenes of violence;
• spam, advertising of third-party resources, phishing links;
• malicious code, attempts of unauthorized access;
• materials that violate intellectual property rights.

11.2. Automated data collection from the Website (parsing) without the Administration’s consent is prohibited.

12. Moderation and blocking

12.1. The Administration has the right, without prior notice, to delete content that violates the Rules.

12.2. In case of repeated or gross violations, the Administration has the right to restrict the User’s access to the Website or its individual features.

12.3. The User has the right to appeal the Administration’s actions by sending a request to shop@essens.ru.

13. Intellectual property

13.1. Website content (texts, images, logos, design) belongs to the Administration or rights holders and is protected by the legislation of the Russian Federation.

13.2. Copying, distribution or other use of Website content without the written consent of the Administration is prohibited.

14. Links to third-party websites

14.1. The Website may contain links to third-party resources. The Administration does not control their content and is not responsible for their operation.

15. Limitation of liability

15.1. The Website is provided “as is”. The Administration does not guarantee uninterrupted operation of the Website and is not liable for possible technical failures.

15.2. The Administration is not responsible for the content of user content, but takes reasonable measures to prevent violations.

16. Dispute resolution

16.1. Before going to court, the User sends a claim to shop@essens.ru or to the postal address of the Administration.

16.2. The claim review period is 30 (thirty) calendar days.

16.3. The legislation of the Russian Federation applies to the Rules and relations between the parties.

17. Amendment of the Rules

17.1. The Administration has the right to amend these Rules. The new revision comes into force from the moment it is posted on the Website.

17.2. The current revision is available at https://essens.ru/en/pravila.html.
